Forensic Order Reviews

Forensic Order (mental illness) Review:

If the Tribunal confirms a forensic order, you will continue to receive treatment and care outlined in the forensic order. There are various categories of a forensic order. They are as follows: 

  • Community Category: This category will only be used of the Tribunal are satisfied there is no unacceptable risk to the safety of the community. The Tribunal can decide whether the treating doctor can change community treatment in the future
  • Inpatient Category: The person on the order can have limited community treatment. A treating doctor cannot approve more limited community treatment that the amount which has been decided by the Tribunal 

The Tribunal can decide whether to make, change or remove conditions but cannot make a decision regarding specific medications or dosages. The Tribunal can make decisions about whether to transfer the person on the order to another mental health service.

When deciding to revoke a Treatment Authority, the Tribunal must also decide whether to make a Treatment Support Order. The Tribunal can make a Treatment Support Order if they believe that it will better protect the safety of the community than a forensic order. 

Forensic Order (disability) Review:

A notice of hearing will be given to all involved at least 14 days prior to the hearing and the clinical report must be given to both the Tribunal and the patient at least 7 days prior to the hearing. All other documents must be submitted to the Tribunal and other relevant parties at least 3 days prior to the hearing.
